THE ENVIRONMENTAL EXPERTISE AS A PREPONDERANT FACTOR FOR THE ENVIRONMENT PRESERVATION
Abstract
The interaction between man and space promotes changes in the environment that may be positive or negative, but disorderly actions both urban and rural have been causing environmental impacts that run away from the capacity of nature to self-recover. The objective of this study was to correlate these environmental impacts that are putting collective health at risk with the importance of environmental expertise in actions aimed at guaranteeing the right to the ecologically balanced environment, ensured through Art. 225 Federal Constitution. The applied method was the deductive, based on the analysis of the verified data and consultation with the national legislation. It is concluded that Environmental Expertise has high legal importance, not only providing data that base a responsibility for the damages caused, but acting directly to ensure the preservation of the environment.
